§1 General Services provided by Andreas Knapp (hereinafter referred to as “Knandi”) are based on these terms and conditions. They also apply to future transactions unless explicitly agreed otherwise. Deviations from these conditions are valid only after written confirmation by Knandi.
§2 Contract Conclusion Offers from Knandi are non-binding. Orders are considered accepted when confirmed in writing by Knandi, either by letter or email.
§3 Scheduling Dates and deadlines must be documented in writing. The client acknowledges the evidential value of email correspondence.
§4 Order Commitment For orders placed online or via email, Knandi sends a confirmation via email. The client must check this confirmation, print it, sign it, and return it. Upon receipt of the signed confirmation, the order becomes binding.
§5 Order Execution and Modifications Upon order confirmation, Knandi commences work and provides drafts within the agreed timeframe. The client can request modifications or a second draft. Additional changes will be charged based on effort.
§6 Client’s Responsibility The client is responsible for the provided materials, especially concerning copyrights. Any liability for infringements lies with the client, except for materials provided by Knandi.
§7 Compensation Payment is based on the offer or the prices indicated online unless a fixed price has been agreed upon.
§8 Payment and Acceptance Payment is due upon acceptance. If not accepted within 10 working days after receiving the draft, it is considered accepted.
§8a Acceptance Acceptance should occur within 5 working days. If not accepted within 10 days after a reminder, the draft is considered accepted.
§8b Cancellation Cancellation after non-acceptance of the second draft does not exempt the client from the obligation to pay.
§8c Payment Delay In case of payment delay, Knandi can demand interest for late payment.
§9 Warranty Knandi commits to careful execution and free rectification in case of defects. Claims for damages are excluded, except in cases of intent or gross negligence.
§10 Limitation of Liability Further claims are excluded unless they are based on intent or gross negligence by Knandi.
§11 Advertising Rights Knandi may use created works as references and place a link to his own website.
§12 Jurisdiction The jurisdiction is Munich. German law applies.
§13 Final Provisions Invalid provisions will be replaced by valid ones that come closest to the intended purpose.
